Judge Orders Newport Beach to Move Forward With November Vote on Three Charter Measures

A legal fight over three Newport Beach ballot measures is continuing after an Orange County Superior Court judge ordered the city to take the steps necessary to put the measures before voters in the November 2026 election.

Judge Julianne Bancroft issued an emergency order Sept. 2 after previously ruling that the City Council abused its discretion when it voted to place the measures on the November 2028 ballot instead of this year.

What the Three Measures Would Change

The citizen-led charter amendments address council term limits, district elections and government transparency. One proposal would impose a lifetime limit of two four-year City Council terms. Another would change Newport Beach’s current system so voters within each district would elect their own council representative rather than having all council seats decided citywide. A third seeks broader public access to board and commission proceedings through agendas and audio or video records.

Why the Election Timing Is in Dispute

The Orange County Registrar of Voters has said the deadline had passed to add the three measures to the county-administered consolidated election. Bancroft’s latest order directs Newport Beach to conduct the election even if the city must administer a separate municipal election.

City officials say doing so presents major logistical and legal problems and could cost up to roughly $1.2 million. Newport Beach has appealed and is seeking to pause the order while the appellate court considers the dispute.

What Happens Next

The issue remains active litigation, so the final election process could still change. The Newport Beach City Council is scheduled to meet Sept. 8, and residents should watch for additional court rulings and city election updates.
