4 partisan judges are said to be politically motivated to block Trump, appeal is forthcoming
President Donald Trump has been ruled unfit for the Colorado ballot by the state’s Supreme Court Tuesday, setting off a frenzy of angry Americans who believe they have a right to vote for who they want to without 4 judges on the state’s Supreme Court making their decision for them.
Elise Stefanik, (R-NY), said this is nothing but a politically motivated hack job on the former President and whose numbers at the poll continue to surge ahead of failed Biden.
Claims of Election Rigging
Gregg Jarrett, Fox News legal analyst and commentator, shared, “This is ELECTION RIGGING…This is an effort, make no mistake, to deprive American voters of their right to make the decision as to who should be president. It is anti-democratic. It’s the equivalent of rigging the ballot box.”
Colorado Supreme Court Justices Richard L. Gabriel, Melissa Hart, Monica Márquez, and Justice William W. Hood III ruled for the petitioners. Chief Justice Brian D. Boatright along with Justices Maria E. Berkenkotter and Carlos Samour dissented.
“A majority of the court holds that Trump is disqualified from holding the office of president under Section 3 of the 14th Amendment,” the court wrote after its 4-3 ruling.
“We do not reach these conclusions lightly,” the court continued. “We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach.”
Alina Habba, Trump’s attorney released a statement Tuesday night on X, calling on the Supreme Court of the U.S. to reverse the decision confident that the ruling will be overturned “This ruling, issued by the Colorado Supreme Court, attacks the very heart of this nation’s democracy. It will not stand, and we trust that the Supreme Court will reverse this unconstitutional order.”
The basis for the ruling is the 14th Amendment section 3 was put in place to prevent the Confederates from overturning the government after the Civil War.
The justices that ruled in favor referenced the January 6 insurrection as the reason for the decision, even after the full footage was released showing Capitol officers escorting citizens through the Capitol building. Further, Trump has not even been tried or convicted by a court in regards to the allegations.
