Missouri Senator Targets Judicial Overreach with New Legislation
U.S. Senator Josh Hawley (R-Mo.) announced he will be introducing legislation aimed at restricting district court judges from issuing nationwide injunctions, which he claims have been used unconstitutionally to obstruct President Donald Trump’s agenda. Hawley announced his intent on Thursday, stating, “District Court judges have issued RECORD numbers of national injunctions against the Trump administration – a dramatic abuse of judicial authority. I will introduce legislation to stop this abuse for good.” He later added, “STOP NATIONWIDE INJUNCTIONS. Democrats are trying to kneecap President Trump’s agenda with unelected activist judges. It’s out of control. I’m introducing legislation to stop it now.”
The proposed bill, introduced on March 21, seeks to limit the scope of judicial orders that block federal policies across the entire country, a practice Hawley and other conservatives argue undermines executive authority. While specific details of the legislation remain limited, Hawley’s office confirmed it would prevent individual district judges from issuing injunctions beyond their jurisdictions, requiring broader judicial consensus for nationwide impact.
15 Nationwide Injuctions in February Alone
The move comes amid a surge of lawfare challenges by Democrat activist judges to Trump’s second-term policies, with district courts issuing over 15 nationwide injunctions in February alone, according to White House Press Secretary Karoline Leavitt. Hawley’s legislation aligns with growing Republican criticism of what they call “activist judges,” a sentiment echoed by Utah Senator Mike Lee, who recently labeled such rulings “an unprecedented assault on legitimate presidential authority.”
In a new development on March 21, the Senate Judiciary Committee scheduled an emergency hearing for March 25 to review Hawley’s bill, signaling swift action as Trump allies push to expedite its passage. Committee Chair Dick Durbin (D-Ill.) criticized the proposal, arguing it “risks weakening judicial checks on executive overreach.”
Curbing Judicial Power
Hawley, a vocal Trump supporter, has made curbing judicial power a priority after a lone San Francisco district court judge attempted to order a flight full of illegal immigrant, gang member terrorists to turn around and come back to the United States. The action is what Republicans are calling a clear and flagrant abuse of district court authority – making decisions unilaterally that even the Supreme Court can’t operate that way. Further, this district court judge, Judge Boasberg then demanded the Trump administration provide him full records of the flight logs to see if they were “compliant” with his too little too late judgment. The legislation’s fate is a slam dunk for common sense Americans.
