State Retreats After Unlawful Warrant Raid on Christian School
Calvary Christian Academy in San Jose has won a sweeping legal victory after California’s Occupational Safety & Health Appeals Board wiped out every citation the state issued during an illegal warrant–backed raid in 2020 and 2021.
– OSHA (Occupational Safety and Health Administration) originally issued 15 citations totaling $67,330 in penalties.
– Final outcome: All withdrawn. $0 owed. No wrongdoing admitted.
What Happened
In the thick of COVID-era restrictions, Cal/OSHA secured and executed a search warrant—later criticized by the courts as “utterly devoid of detail”—to investigate mask-related complaints at the Christian school.
Advocates for Faith & Freedom challenged the warrant, arguing the agency bypassed due process, failed to verify allegations, and weaponized bureaucratic power against a religious institution.
After years of appeals, the state backed down completely.
What Advocates Are Saying
Joel Oster, Vice President and Chief of Trial Litigation for Advocates for Faith & Freedom, called the outcome “a complete victory, not only for Calvary Christian Academy, but for every church and Christian school in California.”
He added: “The State tried to use OSHA as a weapon to intimidate a religious institution. They failed.”
Attorney Nicolai Cocis praised the ruling for reaffirming constitutional protections: “This underscores the importance of due process and the protection of religious freedoms against unwarranted governmental overreach.”
Why It Matters
- – Religious liberty strengthened: State regulators cannot use health mandates to target churches or Christian schools.
- – Parental rights protected: The case began with mask mandates imposed on children and schools. The ruling draws a line against government overreach.
- – A major precedent: Agencies must follow the Constitution. They cannot rely on thin affidavits, rushed warrants, or political pressure to intrude on religious communities.
This decision could shape how future disputes between public health regulators and religious institutions are handled in California and beyond.
Faith Perspective
Scripture reminds believers to “stand firm” when facing unjust authority (Ephesians 6:13). This case became a real-world example: a Christian school pressured by the state, yet ultimately vindicated when truth and due process prevailed.
For many Christian parents and pastors, this victory affirms a core conviction: government authority has limits, and religious liberty is not granted by the state—it is protected by God and the Constitution.
It also serves as a reminder that faith-based institutions must remain vigilant. When government power expands beyond its proper bounds, the church must respond with both courage and conviction.
