Supreme Court Sends Key Idaho Abortion Case Back to Ninth Circuit for Further Consideration

Liberty Counsel Founder and Chairman Mat Staver commented on the decision, saying, “This order means that the case returns to the Ninth Circuit, which had ordered that the appeal of the preliminary injunction be decided by the full court on an expedited basis without any further briefing. The abortion ban currently remains in place in Idaho, except for those in emergency room situations.”

Implications for Idaho’s Defense of Life Act

Despite the Biden administration’s efforts, there has been an acknowledgment during the proceedings that EMTALA would rarely override Idaho’s law, even under a reinterpreted application. This is a key reason why the Supreme Court opted to send the case back for further consideration.
